1. Basic Provisions/Scope
The following General Terms and Conditions apply to all orders placed through our online shop.
These terms and conditions apply to contracts that you conclude with us, Tortuga de Oro, as the provider (B. Burde), via https://www.tortugadeoro.com. Unless otherwise agreed, the inclusion of any terms and conditions you may use is hereby rejected.
Our online shop is exclusively for consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, is acting in the course of its commercial or independent professional activity.
2. Contractual Partners, Conclusion of Contract, Correction Options
The subject matter of the contract is the sale of goods and services. By placing the products in the online shop (https://www.tortugadeoro.com), we submit a binding offer to conclude a contract for these products. The terms and conditions are stated in the item description. You can add our products to your shopping cart without obligation and correct your entries before submitting your binding order by using the correction options provided during the checkout process.
The contract is concluded when you accept the offer for the products in your shopping cart by clicking the order button. You will receive an order confirmation by email immediately after submitting your order.

The goods you intend to purchase are placed in the online shopping cart. You can access this cart and make changes via the corresponding button.
After accessing the "Checkout" page and entering your personal data and payment details, the order information is displayed as an order summary.
If you choose to use an instant payment system such as PayPal or Google Pay, you will either be taken directly to the order summary page in our online shop or redirected to the website of the instant payment system provider.
If you are redirected to the respective instant payment system, please make the appropriate selections/enter your information there. Finally, the order details will be displayed as an order summary on the provider's website (instant payment system) or after you have been redirected back to our online shop.
Before submitting your order, you have the opportunity to review the information in the order summary, make changes, and/or cancel the order. By submitting the order (via the button), you legally accept the offer, thereby concluding the contract.
Order processing and the transmission of all information required in connection with the conclusion of the contract are carried out partly automatically via email. You must ensure that the email address you have provided to us is correct, that you can receive emails, and that they are not blocked by spam filters.
3. Contract Language
We do not store the complete contract text. Before submitting your order via the online shopping cart system, you can print or save the contract details electronically using your browser's print function.
4. Delivery Terms

We deliver within the Federal Republic of Germany.
4.2. Delivery Options
We ship the products to the delivery address specified during the ordering process. We only deliver via mail.
5. Right of Retention, Reservation of Title
You may only exercise a right of retention if it pertains to claims arising from the same contractual relationship.
The goods remain our property until full payment of the purchase price.
6. Transport Damage
If goods are delivered with obvious transport damage, please report such damage immediately to the delivery driver and contact us. Failure to report damage or contact us will not affect your statutory rights and their enforcement, in particular your warranty rights. However, your cooperation helps us to assert our own claims against the carrier or transport insurance company.
7. Warranty and Guarantees

If a characteristic of the goods deviates from the objective requirements, the deviation is only considered agreed upon if you were informed of it by us before we submitted your contractual declaration and the deviation was expressly and separately agreed upon between the contracting parties.
8. Warranty
Choice of Law
German law applies. For consumers, this choice of law applies only to the extent that it does not deprive them of the protection afforded by mandatory provisions of the law of the state in which they have their habitual residence (principle of most favorable law).
The provisions of the UN Convention on Contracts for the International Sale of Goods (CISG) do not apply.

If you are a consumer, the law stipulates that the risk of accidental loss or damage to the goods during shipment passes to you only upon delivery, regardless of whether the shipment is insured or uninsured. This does not apply if you have independently commissioned a transport company not designated by the seller or another person responsible for carrying out the shipment.
